About these terms
Throughout these terms, "ESA Letter Therapist", "we" and "us" mean [to be completed: legal business name], while "you" means whoever is using the site or our services. These terms incorporate our privacy policy, our notice of privacy practices and our refund policy.
What our service provides
Through our service, a licensed therapist holds a brief evaluation with you, by phone or video, and decides whether, clinically, you should receive a housing letter for an emotional support animal (ESA). When the therapist concludes it is, you get a signed ESA letter in PDF form.
The evaluation has a narrow purpose. It isn't ongoing therapy or emergency care, and it doesn't replace your relationship with your own health care providers.
Who can use our service
You need to be 18 or older [to be completed: confirm age requirement and any process for minors] and be physically present in a state where our therapists are lawfully able to evaluate you. Your state is confirmed during booking.
You promise that what you tell us about yourself, your health and your animals is accurate, complete and true. Each booking must be for you personally and not for anyone else.
Independent clinical decisions
A licensed therapist decides, as a matter of clinical judgment based on your evaluation, whether to issue a letter. Approval is never promised, and neither booking nor paying gives you a right to a letter.
In California, Health and Safety Code section 122318 requires a clinical evaluation and a client relationship of 30 days or longer before documentation for an emotional support dog can be issued. California clients therefore get a letter of intent on the day of the evaluation and the ESA letter following a check-in close to day 30.
Pricing and payment terms
Booking costs nothing, and you're charged only when the therapist issues a letter. At present, an ESA letter listing one or two animals is $129, a letter for three or more animals is $199, and a college housing letter is $129. We don't offer subscriptions or memberships.
An outside payment company processes all payments. Our refund policy governs any request for a refund.
Limits of an ESA letter
An ESA letter is information you can choose to hand a housing provider along with your request for a reasonable accommodation. It can't ensure that a landlord, school, airline, employer or business will accept your animal.
The Americans with Disabilities Act treats an emotional support animal differently from a service animal, and gives it no right of entry to public places. Airlines have no obligation to take ESAs. Federal and state rules shift over time, and housing providers weigh each request for an untrained ESA on its own facts. What we publish is general information and not legal advice.
Your obligations as a user
Where the law and professional rules allow, we may refuse or cancel services, or revoke a letter, if we find out that you gave us false information or that a letter is being misused.
- Be truthful when you book and during your evaluation
- Use your letter only for yourself and for the animals named in it
- Never change your letter, make copies for other people, or misrepresent what it says
- Never pass off an emotional support animal as a service animal, which many states penalize
- Stay accountable for how your animal behaves and for any damage it does
- Never abuse the site, tamper with its security or use it for anything unlawful
Emergencies and crisis help
Our service isn't built for emergencies. When you're in crisis or thoughts of self-harm come up, dial or text 988 for the Suicide & Crisis Lifeline, and in an emergency, dial 911.
Site content and ownership
We or our licensors own everything on esalettertherapist.com, including the text, design and logos. You're welcome to view and print pages for your own non-commercial purposes. Your ESA letter is supplied for your personal use only.
Disclaimers and liability limits
The site and its general information are offered "as is". As far as the law permits, we disclaim any warranty these terms don't expressly give, and we aren't responsible for indirect or consequential losses, a housing provider's ruling on your request among them.
These terms don't restrict any liability that the law says can't be restricted, including the professional duties licensed therapists owe. [to be completed: liability cap and any additional limitations, reviewed by counsel.]
Resolving disputes and governing law
If something concerns you, please start by emailing support@esalettertherapist.com so we have a chance to settle it informally.
